CC&R REMINDERS

 
The Board of 14 Park Place would like to remind all members to review the CC&Rs in their entirety to ensure compliance with community rules and procedures. It is the member’s duty to maintain compliance. As a courtesy, here are some common reminders to our community. It is important to note that this list does not encompass all CC&R rules, but consists of the more common issues that arise within the community. It is the goal of the Board of 14 Park Place to maintain high standards and integrity within our community to strive to be a premier location to live within Nixa.
 
  It's recommended that trash be placed at the curb the evening prior to service (currently every Tuesday morning).  In addition, all carts must be removed from the curbside by midnight on the day of service.  If your trash cart is noted as being out of compliance during routine and random audits, a Notice of Violation will be sent and assessments may be issued. It is important to note that placing your trash cart on the side or behind your house will not meet the requirement of “Not Visible From Neighboring Property” per the CC&Rs. Failure to comply will result in progressively higher assessments.
 
Animals shall not be allowed loose or unsupervised on any part of the property, except in the confines of their Owner’s backyard, which shall be secured by a fence as described in the CC&Rs. The FAQ page for City of Nixa regulations for dogs can be found at http://www.nixa.com/departments/police-department/animal-control-faq. It is the members’ responsibility to ensure all City and CC&R regulations are being followed. Walking of pets shall be on a leash and allowed only on such portions of the property as the Association may prescribe by its Rules and Regulations. Any person found in violation of the rules regarding animals shall be subject to a fine of no less than
$25.00.

• Deck and fence audits are conducted throughout the year. Pursuant to the CC&Rs, no building, structure (including decks) or fence shall fall into disrepair and at all times be kept in good condition, repaired and adequately painted or otherwise finished. Warning letters will be issued soon. Violations may also be assessed at the Board’s discretion for non-compliance.

In regards to fences for 14 Park Place, here are main details.  Please review the CC&Rs for all requirements:

Privacy fences may not exceed forty-eight (48) inches in height. (There are some exceptions if your property lines adjoin with non-14 Park Place properties). Supporting structures (posts) shall be placed on the side of the fence facing the property of the owner building the fence (inside of the fence). Fences must be constructed inside the property line of the homeowner. Complete details, materials of construction, and plan of the proposed fence must be submitted to the Architectural Committee for review prior to construction.  This can be accomplished with a sketch or aerial photo marked up.  The City of Nixa requires a fence construction permit and that must also be provided to the Architectural Committee before approval can be obtained. There are additional requirements for fences in the front and sides of a home.

Please remember that certain improvements to the exterior of your property require Architectural Committee approval. Any major landscaping, deck and patio and fences (among others improvements) require approval by the Architectural Committee of 14 Park Place and possible permits from the City of Nixa before work begins. If you wish to change the color of paint or exterior colors (paint/stain, etc.), please obtain architectural committee approval. Please review your CC&Rs and comply with all requirements.

As a reminder, the CC&Rs directly prohibits trailers, mobile home, trucks larger than ¾ ton, camper, boat, etc. being parked, kept, maintained or repaired upon any property or street within 14 Park Place from 12 midnight and 5:00 a.m. Additional rules and regulations regarding personal property should be reviewed within the CC&R documents. A 24- hour grace period may be given for loading and unloading. A Notice of Violation will be issued and assessments may be incurred. Repeated violations of this section will result in progressively higher assessments at the Board’s discretion for non-compliance.

Please maintain your lawns are properly trimmed and cultivated and free of trash, weeds and other unsightly materials.

Please note that a 25 mph speed limit exists throughout the property.

Dues are $350. Any payments received after March 31st will be assessed a $30 late fee. Unpaid dues may be subject to a property lien.
